Alec concentrates his practice on business litigation and transactional work. Alec’s most recent experience and achievements include:
 
Employment Law
  • Advised employers on issues related to various employment laws, unemployment claims, and issues pertaining to Covid-19;
  • Represented employers on unemployment claims, EEOC claims, and lawsuits in State and Federal court related to Title VII, the ADA, the FMLA, the FLSA, among others;
 
Media and First Amendment Law
  • Defended media companies and other businesses related to defamation claims;
  • Represented individuals, media companies, and other businesses related to Freedom of information Act (“FOIA”) requests and litigation;
  • Represented media companies in other First Amendment litigation including prior restraints;
 
Business Law
  • Represented numerous companies, both large and small, in various contract disputes;
  • Obtained large arbitration award in representation of franchisee in dispute with large national franchisor;
  • Obtained jury verdict in representation of national construction company in complex construction litigation against multi-national Fortune 100 company;
  • Represented both employers and employees in negotiation of employment agreements, including non-compete agreements;
  • Represented large national bank in numerous collection matters;
  • Successfully represented creditor in defending against claim by large Fortune 500 company seeking preferential creditor treatment;
 
Initiative and Referenda
  • Advised clients on Arkansas’ citizen initiative and referenda process;
  • Obtained preliminary injunction in action by ballot question committee to bar enforcement of unconstitutional paid canvasser requirements, unanimously affirmed on appeal;

Alec Gaines practices in the area of business, commercial, and general litigation.

Mr. Gaines has experience handling a variety of cases for corporations large and small. He advises employers and leads workshops on issues pertaining to Title VII, the Americans with Disabilities Act, the Age Discrimination in Employment Act, the Fair Labor Standards Act, and the Family and Medical Leave Act, among others. Mr. Gaines has represented media companies on various matters, including defamation defense, First Amendment, and FOIA issues. He is a contributor to the Media Law Resource Center’s guide to Media Libel Law, as well as its guide to Employment Libel and Privacy Law. Mr. Gaines has handled a variety of business disputes, including cases involving the Arkansas Franchise Practices Act, construction disputes, non-compete agreements, and a wide variety of breach of contract claims. Mr. Gaines has also represented creditors in a variety of collection matters. He successfully argued that a rival creditor could not obtain a “super priority” to contingent trust distributions in the Arkansas Supreme Court case J.B. Hunt, LLC v. Thornton, 2014 Ark. 62, 432 S.W.3d 8.

Mr. Gaines is a member of the American, Arkansas and Pulaski County Bar associations. He is a member of Trinity Episcopal Church in Little Rock and golfs in his free time.
